Terms of service

These terms apply when you buy a service from Gaur Kripa Digital ("we", "us"), run by Nitin Patil in Surat, Gujarat, India. A written proposal or invoice for your project forms part of these terms. If the two differ, the proposal or invoice wins. Questions go to nitin@gaurkripadigital.com.

Plans, prices and billing

• USA, UK and other international clients are billed in US dollars (USD) at the prices on our USA website, or in British pounds (GBP) at the prices on our UK website. These prices include calls in your business hours, creative written for your customers, and reporting aligned to your time zone.
• India plans are available only to businesses registered in India, billed in Indian rupees (INR) with an Indian billing address or GST number. India prices are shared on request and are not available to businesses outside India.
• Monthly plans are billed in advance at the start of each month. One-off projects, such as websites, are billed 50% at the start and 50% before launch.
• Ad spend is always paid by you directly to the ad platform (such as Meta or Google) and is not part of our fees. Tools you choose, such as an email platform or SMS provider, are also paid by you.

Month to month

Monthly plans have no minimum term. You can stop at the end of any billing month by telling us by email before the next month starts. Fees already paid for the current month are not refunded, except under our guarantee below.

Our guarantee

For ad management plans, your campaigns go live within 7 days of us receiving working access to your ad account, tracking and any creative or details we asked for. You also get a report every Monday. If we miss either, that month's management fee is waived. The guarantee covers our fee only, not ad spend, and it does not promise a number of leads or sales, because results also depend on your offer, market and budget.

What we need from you

• Access to your ad accounts, website and tools, using partner or manager access where the platform allows it
• Accurate information about your business, offers and prices
• Feedback and approvals within a reasonable time, so we can keep to the timeline

You are responsible for the claims in your ads and on your website being true, and for having permission to contact the people on any list you give us.

Ownership

Your ad accounts, pixels, pages, websites, domains and data stay in your name. When a website or creative project is paid in full, the final designs and copy we made for you are yours to use. We may show the work, and results without your name or private figures, as examples of what we do, unless you ask us not to.

Confidentiality

We keep your business information, data and results private and use them only to do the work you asked for. Our privacy policy explains how we handle personal information.

Liability

We do our best work with care, but ad platforms, search engines and other tools are run by other companies and can change, suspend accounts or go down without notice. We are not liable for losses caused by those platforms or by results that fall short of a forecast. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

Changes and governing law

We may update these terms, and the date at the top of this page will change when we do. Changes do not affect work already invoiced. These terms are governed by the laws of India, and the courts of Surat, Gujarat have jurisdiction, unless the law where you are based gives you rights that cannot be excluded.
